FedEx has filed a lawsuit seeking reimbursement of tariffs recently struck down by the Supreme Court. The shipping giant’s complaint, lodged on February 23 with the U.S. Court of International Trade, marks the first major legal action following the Court’s 6-3 decision that President Donald Trump lacked authority to impose tariffs under the International Economic Emergency Powers Act (IEEPA). FedEx argues that Customs and Border Protection must refund duties paid last year, which the Court deemed unlawful.
The company had previously warned of a $1 billion fiscal hit from global trade tensions. Other firms, including Costco, Revlon, Kawasaki, and Bumble Bee Foods, had challenged the tariffs before the ruling. While the Court invalidated the duties, it did not clarify whether refunds would be issued, leaving businesses in a legal gray zone. Many industries have already absorbed tariff costs into contracts and pricing, complicating potential recovery efforts.
