Malaysia’s Housing Ministry Proposes New Law to Protect Buyers of Abandoned Commercial Properties

The Housing and Local Government Ministry in Malaysia is exploring a new Real Property Development Act (RPDA) to address abandoned commercial properties and enhance consumer protections, as the current Housing Development Act 1966 only covers residential developments. The RPDA would extend legal safeguards to buyers of mixed developments like retail and small office units, introducing an Option to Purchase framework to allow termination of Sale and Purchase agreements if buyers are dissatisfied. Additionally, the ministry is considering a Building Managers Act to improve property management, addressing the shortage of licensed firms managing Malaysia’s 26,334 strata schemes. The ministry has also revived 1,044 private housing projects worth RM100.1 billion, benefiting 124,539 homebuyers.
