In Kuala Lumpur, the High Court heard arguments that the Sessions Court’s dismissal of Toh Puan Na’imah Abdul Khalid’s application to refer legal questions to the High Court was a miscarriage of justice. Na’imah’s counsel, Datuk Dr. Gurdial Singh Nijar, argued that the dismissal denied his client clarity on her legal position and urged the High Court to rectify this to uphold judicial integrity.
Na’imah faces charges for allegedly failing to declare assets to the Malaysian Anti-Corruption Commission (MACC). Gurdial described the charge as “purely technical” and possibly retaliatory, noting that Na’imah was initially a witness assisting in an investigation against her late husband, Tun Daim Zainuddin. Despite complying with an MACC notice to disclose asset information, the agency deemed her compliance insufficient, leading to the charges. Gurdial argued that the Sessions Court’s dismissal was based on a misconception of law and procedure, misrepresenting the nature of the charge against Na’imah.
